General conditions of sale

1. Any order implies the customer's complete and unreserved acceptance of these general conditions of sale and the renunciation of clauses in their own general conditions of purchase which are contrary to them.

2. Quotations, Orders and Estimates

a. All quotations made remain in force for a period of 14 days ; after that period they may be subject to a revision. The estimated time for completion of a translation or other project is given in good faith but as an indication only of the probable time required for the work. Such an estimation starts from the working day after the reception of the documents to be translated or treated.

b. If after placing an order for a translation or other project the customer cancels his order, the total amount of the order will nevertheless be invoiced to the customer.

c. A customer placing an order for a translation or other project is considered to have the right to do so. Helen MUNDUTEGUY cannot be held responsible for non respect of copy-right or other rights of third parties.

d. Quotations of price are based on pre-viewing of the whole of the original document before supplying a quotation. Work done after an estimate (without viewing the complete document) will be invoiced according to the number of words, standard lines, or pages in the original text, or by the hour as agreed with the customer.

3. Responsibility - Ownership

a. No liability is assumed by Helen MUNDUTEGUY for any error or event beyond our control or for any consequential damages of any kind. Any and all liability shall be confined to correcting errors in translated texts. No liability is accepted for any consequential damages.

b. In the absence of a signed written order, Helen MUNDUTEGUY cannot be held responsible for any errors of interpretation resulting from a lack of written information from the customer.

c. The property of the translated works or projects and all rights pertaining to these works or projects remain the property of Helen MUNDUTEGUY until such time as full payment has been received including any interest due on the payment. Until full payment has been made for a translation or other project it cannot be used, or reproduced without specific permission.

4. Claims

Any claim concerning a translation or project should be addressed to Helen MUNDUTEGUY by registered letter within seven days of reception of the work. The absence of any complaint within seven days indicates the unconditional acceptance of the delivered translation or project.

5. Conditions of Payment

All bills and invoices are payable on presentation, as provided by the EU directive n° 2000/35/EC of 8th August 2000. Payment will follow immediately on receipt of each bill or invoice, in cash (€ only by registered mail), by cheque in euros, international money order, bank wire transfer or other means as required on our estimate, quotation or acceptance for the work. Any bill or invoice not paid within 30 days of reception will then be subject to interest at a rate 7% above the rate of interest of the European Central Bank.

Professional experience

I guess I started translating during my research work here in France since I wrote my own articles in both French and English and very much helped my French colleagues when writing in English.

Since then I spent a couple of years (2005 – 2006) working for my parent's translating business – Hutchings Traductions. With them I worked on various types of documents for major pharmaceutical companies (patents, market authorisations, scientific and medical articles, clinical trials, etc.) and research facilities.

As a freelance translator, I have recently translated for the French research organisations INSERM and CNRS as well as various university research units. I also work regularly for INVS (French Institute for Public Health Surveillance) and the association “France Mederic Alzheimer”.

As to my interest for translations concerning mountaineering and adventure sports, I have translated the entire website of a French trekking agency – Viamonts Voyages and I have worked on a campaign for preventing mountaineering accidents with the local department of the French Ministry of Health, Youth and Sport.

Au cours de mes travaux de recherche, j'ai écrit et publié plusieurs articles aussi bien en anglais qu'en français. J'ai également assisté de nombreux collègues en relisant leurs manuscrits rédigés en anglais avant soumission.

Depuis, j'ai « appris » la traduction en travaillant en tant que salariée pour l'entreprise Hutchings Traductions. Pendant cette période (2005 – 2006), j'ai travaillé sur différents types de documents (brevets, articles, autorisations de mise sur le marché, essais cliniques …).

Aujourd'hui, je suis installée à mon compte. Je continue à travailler avec Hutchings Traductions, des entreprises pharmaceutiques et des organismes publics du domaine biomédical.

Conditions Générales de Vente

1. Toute commande de traduction ou autre travail emporte de plein droit de la part du client son adhésion sans réserves aux présentes conditions générales de vente et renonciations aux clauses de ses propres conditions générales d'achat qui y seraient contraires.

2. Devis, Commandes et Estimations d'Honoraires a) Tout devis et toute estimation d'honoraires donné reste valable pendant 15 jours, passé ce délai, s'il n'a pas été accepté, il pourra être sujet à révision. Les délais sont donnés à titre indicatif et de bonne foi. Ils prennent cours à partir du jour ouvrable suivant la réception des documents qui sont l'objet du travail demandé. b) Si le client interrompt l'exécution d'une commande, le montant total de cette commande lui sera néanmoins facturé. c) Le client donnant une commande de traduction ou autre travail sur un document est censé en avoir le droit. L'entreprise Helen MUNDUTEGUY ne peut donc être tenue responsable du non respect des droits des tiers en ce que concerne le copyright, les droits d'auteurs, etc. d) Un devis définitif d'honoraires ne peut être donné que si l'intégralité du document original est fournie à Helen MUNDUTEGUY. Les travaux effectués suite à une estimation d'honoraires (quand le document n'a pas été fourni dans son intégralité) seront facturés sur la base du nombre de mots, de lignes standards, de pages dans le texte original ou par heure comme convenu avec le client.

3. Responsabilité - Propriété a) L'entreprise Helen MUNDUTEGUY ne peut être en aucun cas tenue responsable d'erreurs, de circonstances indépendantes de sa volonté, ou de dommages-intérêts indirects. Toute responsabilité est limitée à la correction d'erreurs dans les textes traduits. Aucune indemnité ne pourra être exigée en compensation de dommages ultérieurs. b) En l'absence d'un bon de commande signé, Helen MUNDUTEGUY ne peut être tenue responsable des erreurs résultant d'un manque d'informations écrites par le client. c) L'entreprise Helen MUNDUTEGUY se réserve la propriété de toutes traductions et tous projets effectués, ainsi que de tous droits associés à ces documents jusqu'à paiement intégral du montant total correspondant, comprenant, s'il y a lieu, les intérêts éventuels sur la somme due. Sauf réception de l'intégralité de la somme facturée pour une traduction (ou autre travail) celle-ci ne peut être utilisée ou reproduite sans autorisation explicite.

4. Réclamations Toute réclamation devra parvenir à Helen MUNDUTEGUY par lettre recommandée dans les huit jours suivant la réception des travaux. L'absence de toute contestation entraîne pour le client l'acceptation inconditionnelle et sans réserve des travaux livrés.

5. Conditions de Paiement Toute facture ou note d'honoraire est payable dès réception, selon la directive UE n° 2000/35/EC du 8 août 2000. Le règlement suivra immédiatement la réception de chaque note d'honoraires au comptant (par courrier recommandé), par chèque en euros, par mandat international, par virement ou par tout autre moyen convenu sur l'estimation ou sur le devis final. Tout dépassement de 30 jours de la date de réception donnera lieu à l'application d'agios égale à 7% au-dessus du taux d'intérêt de la Banque Centrale Européenne.
